End User License Agreement (EULA) – iOS

This End User License Agreement (“EULA”) is a legal agreement between you (“the User” or “you”) and AudioCue, a product by Barry’s Web Design (“the Company,” “we,” or “us”). This EULA applies to the iOS version of the AudioCue software (“the Software”).

By installing, accessing, or using the Software, you agree to be bound by the terms of this agreement. If you do not agree to these terms, you must not use the Software.

2. License Grant

Subject to your compliance with this EULA, the Company grants you a non-exclusive, non-transferable, and revocable license to install and use the Software on your iOS devices for your own use. You may not redistribute, resell, or sublicense the Software to any third party.

3. Subscription Terms

AudioCue offers the following subscription options on iOS:

Monthly Subscription – billed monthly, auto-renewable until cancelled.

6-Monthly Subscription – billed every six months, auto-renewable until cancelled.

Yearly Subscription – billed annually, auto-renewable until cancelled.

Payment will be charged to your Apple ID at the time of purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage or cancel your subscription at any time through your iOS device’s subscription settings.

4. Payment and Refunds

All payments are processed by Apple through the App Store. Refunds, where applicable, are handled by Apple in accordance with their App Store refund policies. If you cancel your subscription, you will retain access to the Software until the end of the current billing period.

5. Account Management

You are responsible for maintaining the confidentiality of your account information. If you experience any issues with your subscription or the Software, you may contact us at enquiries@barryswebdesign.co.uk.

6. Restrictions

You may not:

• Modify, reverse-engineer, decompile, or attempt to extract the source code of the Software.

• Distribute, resell, or sublicense the Software to any third party.

• Use the Software for any unlawful or unauthorised purpose.

7. Termination

This agreement will terminate immediately if you fail to comply with any term of this EULA. Upon termination, you must stop using the Software.

8. Disclaimer and Limitation of Liability

The Software is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Software will be error-free or uninterrupted.

To the maximum extent permitted by law, the Company’s total liability to you for any claim arising out of or relating to the Software is limited to the amount you paid for the Software through the App Store. The Company shall not be liable for any indirect, incidental, or consequential damages.

9. Privacy

Your use of the Software is subject to our Privacy Policy, which explains how we collect and use personal data.

10. Governing Law

This agreement is governed by and construed in accordance with the laws of Scotland. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the Scottish courts.
